Attend sessions consistently and arrive on time.
Arrive prepared and ready to participate.
Complete assigned work where applicable.
Follow the study plan or program structure in good faith.
Communicate honestly about study habits, exam readiness, exam timing, and scheduling.
Respect the confidentiality of other participants.
Avoid disruptive, disrespectful, harassing, threatening, unsafe, or inappropriate conduct.
Use materials only for your own personal educational or professional development purposes.
Not record, copy, share, distribute, teach, resell, upload, or misuse program materials.
Take responsibility for your own exam registration, licensure process, board communications, and professional decisions.

Failure to follow program expectations may affect your progress, eligibility for continuation options, access to materials, and continued participation.

10. Use of Outside Materials

Everything Social Work programs may be designed around a specific instructional method, study structure, and preparation strategy.

Participants may choose to use outside materials at their own discretion. However, the participant understands that inconsistent, conflicting, excessive, outdated, unofficial, or poorly aligned outside materials may interfere with the program’s structure and may affect exam readiness.

Everything Social Work is not responsible for outcomes affected by outside study methods, unofficial materials, conflicting advice, participant non-adherence, or failure to follow the program structure.

11. ASWB Retesting and Continuation Policy

Everything Social Work may offer continuation options for certain test preparation programs if a participant takes the applicable exam and does not pass.

Continuation options are not refunds. Continuation options are conditional, limited, discretionary, subject to availability, and subject to Everything Social Work approval.

To be considered for any continuation option, the participant must:

Submit a written request.
Provide documentation of the exam result.
Be current on all payments.
Have attended and participated consistently.
Have followed the program structure in good faith.
Have complied with all program expectations and conduct requirements.
Request continuation within the timeframe required by Everything Social Work.
Comply with applicable ASWB, Pearson VUE, and licensing board rules.

If a participant does not pass by 10 points or less, Everything Social Work may offer one continuation waiver to continue in the next available study group at no additional cost, subject to eligibility, availability, documentation, attendance, adherence, payment status, and written approval.

If a participant does not pass again by 10 points or less, Everything Social Work may offer continued participation in another 10-week program for $200, subject to availability, payment, documentation, adherence, and written approval.

If a participant does not pass by 11 points or more, Everything Social Work may offer continued participation at a rate of $80 per session, subject to availability, payment, documentation, adherence, and written approval.

Everything Social Work may deny continuation if the participant missed excessive sessions, failed to follow the study plan, did not participate in good faith, violated program expectations, failed to provide required documentation, was removed from the program, or otherwise did not meet continuation requirements.

ASWB states candidates generally must wait 90 days between exam attempts, though a waiver may be requested if the candidate is within 10 correct answers of passing and the applicable board allows waivers. Any continuation or retesting expectation is subject to ASWB, Pearson VUE, and applicable licensing board rules.

12. Payments

All prices are listed in U.S. dollars unless otherwise stated.

Payment is required at the time of purchase, registration, booking, or according to the payment terms provided in writing.

You represent that you are authorized to use the payment method provided.

Everything Social Work may use third-party payment processors, website platforms, registration platforms, scheduling tools, or other systems to process payments and manage registrations.

Failure to pay may result in cancellation, revoked access, removal from a program, denial of continuation options, withholding of materials, collection efforts, or termination of Services.

13. Refunds, Cancellations, Rescheduling, and No-Shows

Refunds, cancellations, rescheduling, credits, and transfers are governed by Everything Social Work’s Return, Refund, and Cancellation Policy, any product-specific terms, course-specific terms, event-specific terms, invoice terms, registration terms, or written agreement.

Unless otherwise stated in writing or required by applicable law, all payments are final once enrollment is completed, a seat is reserved, materials are provided, access is granted, preparation begins, services are scheduled, work begins, or the applicable course, study group, workshop, event, consultation, mentoring session, or access period begins.

Refund or reschedule requests must be submitted in writing at least 7 calendar days before the scheduled start date unless a different written policy applies.

No refunds will be provided for no-shows, missed sessions, late arrivals, partial attendance, failure to attend, failure to complete assignments, failure to take an exam, failure to pass an exam, dissatisfaction after participation, change of mind, buyer’s remorse, removal for conduct violations, or failure to achieve a desired outcome.

Florida law places importance on clear disclosure of no-refund policies at the point of sale.

14. Digital Materials, Recordings, and Downloads

Digital products, course materials, downloadable materials, recordings, replay links, study guides, worksheets, slides, templates, practice materials, online resources, and digital access are final sale and non-refundable once purchased, accessed, downloaded, delivered, emailed, opened, or made available, except where required by applicable law.

Everything Social Work may make reasonable efforts to assist with technical access issues, such as resending a link, confirming access, or correcting an administrative error.

15. Intellectual Property

All course materials, study methods, teaching strategies, worksheets, slides, recordings, handouts, study plans, examples, explanations, templates, practice discussions, program structures, digital materials, website content, logos, names, branding, and related materials are owned by Everything Social Work or its licensors.

Participants receive a limited, non-exclusive, non-transferable, revocable license to use materials for their own personal exam preparation or professional development only.

You may not copy, record, reproduce, distribute, publish, upload, share, teach, resell, license, modify, create derivative works from, use to create competing services, or otherwise exploit Everything Social Work materials without prior written permission.

Violation of this section may result in removal from the program without refund and may result in legal action.

16. Confidentiality and Group Participation

Participants may hear personal, professional, academic, or exam-related information shared by other participants.

Each participant agrees to respect the privacy of other participants and not disclose, record, screenshot, post, repeat, publish, or share another participant’s personal information, exam history, scores, licensing status, questions, comments, or experiences outside the group.

Everything Social Work may remove a participant from a program without refund if the participant violates confidentiality, disrupts the group, harasses others, misuses materials, or acts in a way that compromises the safety, privacy, or integrity of the program.

17. Participant Conduct and Removal

Everything Social Work may refuse admission, remove a participant, revoke access, or terminate participation without refund if the participant:

Fails to pay.
Violates these Terms.
Violates program expectations.
Disrupts the learning environment.
Harasses, threatens, or mistreats others.
Violates confidentiality.
Records or distributes sessions without permission.
Copies, shares, uploads, resells, or misuses materials.
Acts dishonestly regarding attendance, exam status, scores, or participation.
Creates safety, legal, reputational, or operational concerns.
Engages in conduct Everything Social Work determines is inappropriate or harmful.

Removal from a program does not entitle the participant to a refund, credit, transfer, continuation option, or replacement service.

18. Testimonials, Reviews, and Success Stories

If you submit a testimonial, review, comment, photo, video, message, feedback, social media tag, or success story to Everything Social Work, you grant Everything Social Work permission to use, reproduce, display, edit, publish, distribute, and share that content for marketing, educational, promotional, or business purposes, unless prohibited by law or otherwise agreed in writing.

You represent that any testimonial, review, or success story you provide is truthful and accurate.

Everything Social Work may use general, non-identifying feedback, aggregate results, or anonymous participant comments for educational, marketing, or improvement purposes.

Everything Social Work will use reasonable care with participant information but cannot guarantee the security of email, text messages, forms, third-party platforms, payment systems, or online tools.

20. Third-Party Platforms and Tools

These may include website platforms, payment processors, email tools, scheduling tools, video conferencing platforms, learning platforms, document tools, analytics tools, advertising tools, and other service providers.

Unless expressly stated in a separate written agreement, Everything Social Work does not provide legal advice, board compliance advice, licensing determination advice, therapy, mental health treatment, clinical supervision, financial advice, tax advice, or employment placement services.

23. Disclaimer of Warranties

Everything Social Work’s website, Services, courses, study groups, workshops, events, consultations, mentoring sessions, digital materials, recordings, downloads, recommendations, and resources are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Everything Social Work disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, reliability, or suitability.

Everything Social Work does not warrant that the website, Services, materials, platforms, or third-party systems will be uninterrupted, error-free, secure, complete, current, accurate, or free from harmful components.

24. Limitation of Liability

To the fullest extent permitted by law, Everything Social Work and its owner, instructors, facilitators, employees, contractors, collaborators, service providers, representatives, and associated team members shall not be liable for indirect, incidental, consequential, special, punitive, or similar damages.

You agree to indemnify, defend, and hold harmless Everything Social Work and its owner, instructors, facilitators, employees, contractors, collaborators, service providers, representatives, and associated team members from and against any claims, damages, losses, liabilities, costs, expenses, chargebacks, disputes, penalties, and attorneys’ fees arising out of or related to:

26. Chargebacks and Payment Disputes

Before initiating a chargeback, payment dispute, formal complaint, or legal claim, you agree to contact Everything Social Work at everythingsocialwork@gmail.com and allow a reasonable opportunity to address your concern.

A product, service, course, study group, workshop, event, consultation, or digital material is not defective, incomplete, or refundable merely because you changed your mind, did not attend, did not participate, did not use it, did not complete assignments, did not take the exam, did not pass the exam, disagreed with the teaching method, were dissatisfied with the outcome, or did not achieve a desired result.

Everything Social Work may use these Terms, its Return, Refund, and Cancellation Policy, product descriptions, course descriptions, invoices, receipts, registration confirmations, attendance records, access records, communications, documentation, and reasonable concern-resolution efforts as evidence in response to any chargeback, payment dispute, or complaint.

Improper chargebacks or payment disputes may result in revoked access, canceled services, collection efforts, recovery of fees, denial of continuation options, and enforcement of Everything Social Work’s rights.

27. Dispute Resolution, Mediation, and Venue

Before filing any lawsuit, arbitration demand, chargeback, formal complaint, or legal claim, you agree to first provide written notice to Everything Social Work describing the dispute and giving Everything Social Work an opportunity to resolve the matter informally.

Your written notice must include your full legal name, contact information, the product, service, course, study group, workshop, consultation, event, transaction, or issue involved, the date of purchase or interaction, a clear description of the dispute, the resolution you are requesting, and copies of relevant documents, receipts, emails, or communications.

Notice must be sent to everythingsocialwork@gmail.com.

The parties agree to attempt to resolve the dispute in good faith for at least 60 days after Everything Social Work receives written notice.

If the dispute is not resolved informally, the parties agree to attempt mediation before initiating court proceedings, unless emergency injunctive relief or equitable relief is necessary to protect intellectual property, confidential information, program materials, payment rights, or other urgent rights.

Mediation shall be conducted before a neutral third-party mediator. The parties shall attempt to mutually agree on a mediator. If the parties cannot agree on a mediator within 15 calendar days after a written mediation request, either party may request selection or appointment of a mediator through a recognized mediation provider or, if a court case has already been filed, by the court with jurisdiction over the matter.

Unless otherwise required by law or agreed in writing, mediation shall occur in Broward County, Florida, including Fort Lauderdale, Florida, or remotely if Everything Social Work agrees.

For any dispute that proceeds in court and is not resolved through informal resolution or mediation, the parties agree to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida, unless otherwise required by law. Broward County’s Central Courthouse is located at 201 SE 6th Street, Fort Lauderdale, Florida 33301.

28. Governing Law, Venue, and Jurisdiction

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict of law principles.

If you access the website or Services from outside Florida or outside the United States, you agree that the laws of Florida and applicable United States federal law govern these Terms to the fullest extent permitted by law, except where non-waivable consumer protection laws provide otherwise.

For any dispute, claim, or controversy arising out of or relating to these Terms, the website, any purchase, registration, course, study group, workshop, event, consultation, mentoring session, digital material, service, or relationship with Everything Social Work that is not resolved through informal resolution or mediation, the parties agree to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida, including Fort Lauderdale, Florida, unless otherwise required by law.

Where a Broward County court filing is required, the applicable courthouse may include the Broward County Central Courthouse, located at 201 SE 6th Street, Fort Lauderdale, Florida 33301, depending on the type of claim and court division.

You agree not to object to jurisdiction, venue, or forum in Broward County, Florida on the basis that it is inconvenient, improper, or otherwise unavailable, to the fullest extent permitted by law.

29. Intellectual Property Remedies

Everything Social Work may seek injunctive relief, equitable relief, monetary damages, attorneys’ fees where available, costs, and any other remedies available by law if you copy, misuse, disclose, distribute, resell, teach, upload, or otherwise exploit Everything Social Work materials, intellectual property, confidential information, or proprietary program content.

30. Modifications to Terms

Everything Social Work may update, revise, or modify these Terms at any time.

Changes will be effective when posted on the website unless otherwise stated.

Your continued use of the website, purchase of Services, registration for programs, or access to materials after updated Terms are posted means you accept the updated Terms.

31. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision shall be modified or interpreted to the minimum extent necessary to make it enforceable, or removed without affecting the remaining Terms.

32. No Waiver

Failure by Everything Social Work to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

Any waiver must be in writing and approved by Everything Social Work.

33. Assignment

Everything Social Work may assign, transfer, delegate, subcontract, or license its rights or obligations under these Terms in connection with a business transfer, restructuring, sale of assets, collaboration, subcontracting relationship, service delivery need, or operational need.

You may not assign or transfer your rights or obligations without written permission from Everything Social Work.

34. Entire Agreement

These Terms, together with the Privacy Policy, Return, Refund, and Cancellation Policy, participant agreements, course disclosures, registration terms, invoice terms, product-specific terms, event-specific terms, or written agreements, constitute the entire agreement between you and Everything Social Work regarding your use of the website and Services.

If there is a conflict between these Terms and a separate signed written agreement, the signed written agreement will control only for the specific subject matter covered by that agreement.

35. Survival

The sections relating to intellectual property, confidentiality, payment obligations, refund limitations, disclaimers, limitation of liability, indemnification, chargebacks, dispute resolution, governing law, venue, and any other provisions that by their nature should survive shall remain in effect after termination, cancellation, completion of Services, removal from a program, or discontinuation of website use.
